SCR 34, 64th R.S.
Granting permission to David Melville "Buck" McCullough, Goodall Wooten "Hank" McCullough, George H. McCullough, and the Estate of Ella Newsome Wooten, by and through the Capital National Bank in Austin, as independent executor and testamentary trustee, to sue the State of Texas in any court of competent jurisdiction, providing that venue for the suit be in Travis County, Texas, providing that in the event suit if filed, service of citation and other required process be made on the Attorney General of Texas and the Chairman of the Board of Regents of the University of Texas System; providing that nothing in this resolution shall be construed as an admission by the State of Texas, or any of its agents, employees, departments, agencies, or political subdivisions, of liability or of the truth of any allegations asserted by the claimant, but the alleged cause of action must be proved under the laws of the State of Texas as in other civil cases; providing that nothing in this resolution shall be construed as a waiver of any defencse of fact or law available to the State of Texas or any of its agenst, employees, departments, agencies, or political subdivisions, but every defense is specifically reserved.
