HBA-JEK, MPM S.J.R. 2 77(R) BILL ANALYSIS Office of House Bill AnalysisS.J.R. 2 By: Wentworth Public Education 3/12/2001 Engrossed BACKGROUND AND PURPOSE Currently, some school districts own historic one-room schoolhouses. As proposed, Senate Joint Resolution 2 requires the submission to the voters of a constitutional amendment authorizing the board of trustees of an independent school district to donate certain surplus property of historical significance in order to preserve the property. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this resolution does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Joint Resolution 2 amends the Texas Constitution to authorize the legislature to authorize the board of trustees (board) of an independent school district to donate district real property and improvements formerly used as a school campus for the purpose of preserving the improvements. The resolution provides that law enacted under this section must provide that before the board may make a donation, the board determine that: _the improvements are historically significant; _the transfer will further preserve the improvements; and _the district does not need the real property or improvements for educational purposes at the time of the transfer. FOR ELECTION This proposed constitutional amendment shall be submitted to the voters at an election to be held November 6, 2001.
