HBA-MSH S.B. 911 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 911 By: Madla State, Federal & International Relations 4/16/2001 Engrossed BACKGROUND AND PURPOSE Current law provides for the creation of defense base development authorities (authority) by municipalities to take over the property of a closed U.S. military base to engage in the economic development of the base property and areas around the base property. A municipality is currently not allowed to create an authority to conduct a base efficiency project to demonstrate methods for more efficient operation of military installations through improved capital asset management and greater reliance on the public or private sector for less costly base support services. Senate Bill 911 authorizes a municipality to create an authority for the purposes of conducting a base efficiency project. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 911 amends the Local Government Code to provide that carrying out a base efficiency project is an additional purpose for which a defense base development authority (authority) may be created. The bill prohibits an authority from operating a defense base that has been closed or realigned under the federal Defense Base Closure and Realignment Act of 1990. The bill requires the board of an authority to perform its duties only if it is consistent with the purpose for which the authority was created. The bill requires an authority to manage the property used for a base efficiency project. EFFECTIVE DATE September 1, 2001.
