HBA-MPM S.B. 620 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 620 By: Jackson Business & Industry 4/5/2001 Engrossed BACKGROUND AND PURPOSE Under current law, the Clear Lake Forest Homeowner's Association (association) cannot vote on the issue of extending mandatory assessments. This authority is currently granted to other subdivisions. Senate Bill 620 extends this authority to the association. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 620 amends the Property Code to apply provisions relating to the extension of restrictions imposing regular assessments in certain subdivisions to a residential real estate subdivision that: _consists of at least 750 homes; _is located in two adjacent municipalities in a county with a population of 2.8 million or more; and _has use restrictions the terms of which are automatically extended, but has a regular assessment that is established by two separate documents permitting the assessment to expire and do not provide for extension of the term of the assessment. EFFECTIVE DATE September 1, 2001.
