HBA-NRS S.B. 293 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 293 By: West, Royce Public Safety 4/17/2001 Engrossed BACKGROUND AND PURPOSE Current law requires the Texas Department of Public Safety (DPS) to ensure that information obtained from a driver's license, commercial driver's license, or identification certificate is used only for law enforcement or governmental purposes. Senate Bill 293 authorizes DPS to permit use of the information by a seller or lessor of goods or services to prevent a criminal offense. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 293 amends the Transportation Code to authorize the Texas Department of Public Safety to permit use of the information on a driver's license, commercial driver's license, or identification certificate by a seller or lessor of goods or services only for the purpose of preventing a specific criminal offense by the seller or lessor or by a customer of the seller or lessor and the seller or lessor does not retain the information after it is no longer needed to prevent that offense. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
