HBA-BSM S.B. 1667 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1667 By: Cain Licensing & Administrative Procedures 5/8/2001 Engrossed BACKGROUND AND PURPOSE Under current law, each alcoholic beverage permit holder is required to make and keep records required by the Texas Alcoholic Beverage Commission (TABC). The law requires that such records be kept for a minimum of four years and be made available for inspection on request of TABC. Senate Bill 1667 authorizes permit holders to store records electronically and in a location that is not on the premises of the permitee. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1667 amends the Alcoholic Beverage Code to authorize permitees who distill, rectify, manufacture, or receive any liquor to retain all required records in electronic or microfiche formats and retain the records on or off the premises. EFFECTIVE DATE September 1, 2001.
