HBA-TBM S.B. 1632 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1632 By: Bernsen Civil Practices 5/7/2001 Engrossed BACKGROUND AND PURPOSE Under current law, only home-rule municipalities are authorized to institute and prosecute suits without giving security for cost and to appeal from a judgment without giving supersedeas or cost bond. This exemption would benefit other types of municipalities. Senate Bill 1632 authorizes all municipalities to file suit or an appeal without providing security. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1632 amends the Civil Practice and Remedies Code to authorize any municipality rather than a home-rule municipality to institute and prosecute suits without giving security for cost and to appeal from judgment without giving supersedeas or cost bond. EFFECTIVE DATE September 1, 2001.
