HBA-CBW S.B. 1271 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1271 By: Bernsen Juvenile Justice & Family Issues 5/6/2001 Engrossed BACKGROUND AND PURPOSE In response to the increasing number of escapes from juvenile correctional facilities, the 76th Legislature established law to punish juveniles who escaped from the custody of the Texas Youth Commission. A person who escapes from a juvenile correctional facility commits a Class A misdemeanor, or a felony if the juvenile causes bodily injury, serious bodily injury, or uses or threatens to use a deadly weapon during the escape. Senate Bill 1271 provides that a person who escapes from a secure detention or correctional facility operated by or under contract with a juvenile board commits a felony of the third degree. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Senate Bill 1271 amends the Penal Code to provide that a person who escapes from a secure detention facility or a secure correctional facility operated by or under contract with a juvenile board commits a felony of the third degree. EFFECTIVE DATE September 1, 2001.
