HBA-EDN S.B. 1236 77(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1236 By: Cain Licensing & Administrative Procedures 5/2/2001 Engrossed BACKGROUND AND PURPOSE Currently, the Alcoholic Beverage Code authorizes a licensee to renew a permit up to 10 days after the expiration date of the license if the licensee pays an additional fee per permit and files appropriate applications. Senate Bill 1236 extends the grace period from 10 days to 30 days and gives the Texas Alcoholic Beverage Commission an opportunity to advise the licensee of the expiration of the permit and the possibility of renewal. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority is expressly delegated to the Texas Alcoholic Beverage Commission in SECTION 1 (Section 6.04, Alcoholic Beverage Code) of this bill. ANALYSIS Senate Bill 1236 amends the Alcoholic Beverage Code to authorize the holder of an alcoholic beverage license or permit to renew the license or permit rather than reapply for an original license or permit if, not later than the 30th rather than the 10th day, after the date of the expiration of the license or permit, the holder files a renewal application and the required license or permit fee with the Texas Alcoholic Beverage Commission (commission) and pays a late fee as provided by commission rules. S.B. 1236 prohibits the holder of a license or permit who does not renew the license or permit before its expiration date from operating until the holder files a renewal application EFFECTIVE DATE September 1, 2001.
