BACKGROUND AND PURPOSE 

It would be beneficial for Texas to remain competitive during upcoming
federal decisions about base closures throughout the United States.  Texas'
military bases should operate such that they reduce long term costs to the
state as well as increase opportunities for investment in infrastructure.
C.S.S.B. 1164 requires the Office of Defense Affairs of the Texas
Department of Economic Development in conjunction with the Texas Strategic
Military Planning Commission to request a report developing a five-year
infrastructure plan from each defense-dependent community in Texas.  

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

C.S.S.B. 1164 requires the Office of Defense Affairs of the Texas
Department of Economic Development (office) in cooperation with the Texas
Strategic Military Planning Commission to identify each defensedependent
community (community)  in Texas and request that each community  coordinate
with the office and develop a five-year strategic infrastructure plan and
submit the plan to the office as soon as possible but no later than July 1,
2002.  The bill sets forth the contents of the strategic infrastructure
plan.  The bill requires the office to compile all plans submitted to the
office into a single report, include in the report its own recommendations
in relation to a comprehensive review of the submitted plans, and submit a
copy of the report and recommendations to the governor, lieutenant
governor, the speaker of the house of representatives, and the chair of
each legislative committee with jurisdiction over defense affairs by
December 1, 2002.  

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001. 

COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.S.B.1164 modifies the original bill by removing the requirement that
the Office of Defense Affairs of the Texas Department of Economic
Development (office) request that each military installation in the state
develop a five-year strategic infrastructure plan (plan) and submit the
plan to the office no later than July 1, 2002. The substitute requires that
the office identify each defense-dependent community in the state and
request that each community coordinate with  the office to develop the plan
and submit the plan as soon as possible but not later than July 1, 2002.
