HBA-LJP H.J.R. 91 77(R) BILL ANALYSIS Office of House Bill AnalysisH.J.R. 91 By: Driver Constitutional Revision, Select 4/20/2001 Introduced BACKGROUND AND PURPOSE Since its adoption in 1876, the Texas Constitution has been amended numerous times. Eliminating some of the obsolete, duplicative, or unnecessary provisions from the Texas Constitution, may make it more clear and accessible to the people of Texas. As proposed, House Joint Resolution 91 requires the submission to the voters of a constitutional amendment to remove certain obsolete, duplicative, and unnecessary provisions. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this resolution does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Joint Resolution 91 amends the Texas Constitution to remove obsolete, duplicative, and unnecessary provisions relating to the term of office of incumbent justices and judges of the Appellate Courts and District and Criminal District Courts, references to the State Judicial Qualifications Commission, and the prohibition on the state from levying ad valorem tax on any property within the state. FOR ELECTION This proposed constitutional amendment shall be submitted to the voters at an election to be held November 6, 2001.
