HBA-DMH H.C.R. 33 77(R) BILL ANALYSIS Office of House Bill AnalysisH.C.R. 33 By: Keffer Transportation 2/22/2001 Introduced BACKGROUND AND PURPOSE The Texas Department of Transportation (TxDOT) plays a significant role in providing for the safety of travelers on Texas highways, through the authorization, installation, and maintenance of traffic-control devices wherever such devices are needed. Traffic-control devices generally serve to alert motorists and pedestrians to situations where caution is necessary, and are particularly warranted in areas where a significant number of school children must travel on a daily basis. Despite this critical need, undue delays in the installation of traffic-control devices in school zones at or near new and existing campuses put school children at risk. House Concurrent Resolution 33 encourages TxDOT to give top priority to the authorization and installation of traffic-control devices wherever a state highway passes through or near a school zone. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this resolution does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Concurrent Resolution 33 provides that the 77th Legislature of the State of Texas expresses its support for the expedited installation of traffic-control devices on state highways at or near school campuses, and encourages the Texas Department of Transportation and the Texas Transportation Commission to implement appropriate policies and procedures for the expedited installation of such devices.
