BACKGROUND AND PURPOSE 

The office of the attorney general awarded RFD & Associates, Inc. a
contract for design, development, testing, and implementation of a legal
case management system.  RFD & Associates, Inc. alleges that the office of
the attorney general has not made payment for additional work requested and
performed and  has breached the contract.  C.S.H.C.R. 203 grants   RFD &
Associates, Inc. the right to sue the State of Texas and the office of
attorney general concerning this matter. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this resolution
does not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

C.S.H.C.R. 203 grants RFD & Associates, Inc. permission to sue the State of
Texas and the office of attorney general.  The resolution prohibits the
total of all damages awarded in the suit from exceeding $650,000 and
specifies that RFD & Associates, Inc. may not plead an amount in excess of
$650,000.  The resolution provides that the Attorney General of the State
of Texas be served process. 

COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.H.C.R. 203 differs from the original by prohibiting the total of all
damages awarded in the suit from exceeding $650,000.
