HBA-TBM H.B. 969 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 969 By: Oliveira County Affairs 2/12/2001 Introduced BACKGROUND AND PURPOSE Currently, municipalities with a population of less than 100,000, and counties with a population of less than 300,000 are able to accept a bid for contracts if that bid is on behalf of a local business and is within three percent of the low bid if that low bid is made on behalf of an out-of-town business. House Bill 969 allows municipalities with a population of 200,000 or less and counties with a population of 400,000 or less to accept the bid made by a local business if it is within three percent of the lowest bid made and the lowest bidder is not a resident of the municipality or county. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 969 amends the Local Government Code to redefine "local government" to mean a municipality with a population of 200,000 or less, rather than 100,000 or less, or a county with a population of 400,000 or less, rather than 300,000 or less. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
