BACKGROUND AND PURPOSE 

Prior to the 77th Legislature, the title of Article 36.29, Code of Criminal
Procedure, was imprecise as a result of previous legislative amendments to
the statute.  House Bill 842 conforms the article title with the content of
the statute and specifies that a judge has discretion to determine that a
juror is disabled from sitting after a felony trial has begun. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 842 amends the Code of Criminal Procedure to specify that a
judge in a felony case has discretion, at any time before the charge of the
court is read to the jury, to determine that a juror is disabled from
sitting.  The bill also conforms the article title with the content of the
statute. 

EFFECTIVE DATE

September 1, 2001.
