BACKGROUND AND PURPOSE 

The Glasscock County Underground Water Conservation District was created in
1981 by the 67th Legislature.  Recently, the district annexed  a portion of
an adjacent county.  Consequently, the district now encompasses more than
Glasscock County.  C.S.H.B. 561 changes the name of the district to the
Glasscock Groundwater Conservation District, provides that the district is
subject to laws of this state relating to groundwater conservation
districts, and modifies provisions regarding  the election of the districts
board of directors. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

C.S.H.B. 561 amends law to change the name of the Glasscock County
Underground Water Conservation District to the Glasscock Groundwater
Conservation District (district),  and sets forth provisions for the
election and terms of directors to the district.  The bill provides that
the district is subject to law set forth in the Water Code pertaining to
groundwater conservation districts. 

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001. 

COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.H.B. 561 modifies the original to require the directors to determine to
which district precincts the annexed land shall be added for purposes of
election of directors.  The substitute adds new language to provide that a
person residing in a proposed district may run for election to the board of
a proposed district.  C.S.H.B. 561 modifies the original to remove the
requirement that the directors draw four numbered precincts for electing
directors and the provision that relates to the redrawing of district lines
after a census.
