HBA-MPM H.B. 549 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 549 By: Nixon, Joe Business & Industry 3/26/2001 Introduced BACKGROUND AND PURPOSE Current law includes provisions regarding a landlord's duty to mitigate damages if a tenant abandons leased premises among provisions generally applicable to commercial and residential landlords and tenants. House Bill 549 removes the duty of a landlord to mitigate damages from these provisions and makes it applicable only to landlords who lease a residential dwelling. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 549 amends the Property Code to transfer provisions regarding a landlord's duty to mitigate damages if a tenant abandons a leased premise in violation of a lease from Chapter 91 to Chapter 92. EFFECTIVE DATE On passage.
