HBA-CCH H.B. 423 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 423 By: Tillery Public Education 3/5/2001 Introduced BACKGROUND AND PURPOSE Under current law, open-enrollment charter schools are not subject to municipal zoning ordinances. Municipal zoning ordinances are in place to ensure that a school is not located in an area which may provide a hazard to student safety. House Bill 423 subjects open-enrollment charter schools to municipal zoning ordinances. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 423 amends the Education Code to provide that an open-enrollment charter school is subject to municipal zoning ordinances. EFFECTIVE DATE September 1, 2001.
