HBA-CMT H.B. 334 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 334 By: Hupp Public Safety 2/20/2001 Introduced BACKGROUND AND PURPOSE Currently, the Department of Public Safety (DPS) is required to disclose, to an individual who provides a written request and pays the required fee, whether a named individual holds a concealed handgun license. This can create a situation in which a potential criminal requests the information to determine whether a potential victim is licensed to carry a concealed handgun. House Bill 334 removes the disclosure requirement by DPS regarding whether an individual holds a concealed handgun license. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 334 amends the Government Code to delete the requirement that the Department of Public Safety disclose to any other individual request on whether a named individual or any individual whose full name is specified on a list is licensed to carry a concealed handgun. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
