HBA-MSH H.B. 3233 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3233 By: Davis, Yvonne Public Safety 4/6/2001 Introduced BACKGROUND AND PURPOSE Current law requires peace officers to complete a continuing education program at least once every 24 months or face having their license suspended by the Commission on Law Enforcement Officer Standards and Education. Certain courses are required including education and training in civil rights, racial sensitivity, and cultural diversity, and if it relates to the officer's duties, the recognition and documentation of cases that involve child abuse or neglect, family violence, and sexual assault and issues concerning sex offender characteristics. However, current law does not specifically require peace officers to receive training in the enforcement of highway and traffic laws. House Bill 3233 prohibits peace officers from enforcing highway and traffic laws unless they attend applicable continuing education courses. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3233 amends the Occupations Code to prohibit a peace officer from enforcing traffic and highway laws if the officer does not attend continuing education courses on the enforcement of traffic and highway laws and does not attend a certification course on the use of radar equipment used to check the speed of a vehicle. EFFECTIVE DATE September 1, 2001.
