HBA-LJP H.B. 3101 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3101 By: Isett Criminal Jurisprudence 3/18/2001 Introduced BACKGROUND AND PURPOSE Current laws that restrict the possession and ownership of firearms do not affect replicas of an antique or curio firearm manufactured before 1899, if the replicas do not use rim fire or center fire ammunition. In order to accurately depict some historical events of Texas history, replicas of an antique or curio firearm manufactured before 1899 are often used in reenactments. House Bill 3101 expands the definition of certain replicas of an antique or curio firearm to include that the replicas be readily available in the ordinary channels of commercial trade. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3101 amends the Penal Code to expand the exclusion from the definition of "firearm" of a replica of an antique or curio firearm manufactured before 1899 that does not use rim fire or center fire ammunition that is readily available in the ordinary channels of commercial trade. EFFECTIVE DATE September 1, 2001.
