HBA-EDN H.B. 307 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 307 By: Hupp State Affairs 2/28/2001 Introduced BACKGROUND AND PURPOSE Under the Motor Vehicle Records Disclosure Act, a state agency is currently authorized to sell personal information obtained in connection with motor vehicle records to various entities for bulk distribution for surveys, marketing, or solicitations if the driver's license holder has not opted to prohibit such uses. House Bill 307 authorizes a disclosure of such personal information only if the person who is the subject of the records provides written consent to the disclosure. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 307 amends the Transportation Code to authorize an agency to disclose personal information obtained in connection with a motor vehicle record to any requestor, who satisfies certain conditions, for use for bulk distribution for surveys, marketing, or solicitations only if the person who is the subject of the record provides written consent to the disclosure. The bill further authorizes an agency to disclose to a requestor ,without regard to intended use, personal information obtained in connection with a motor vehicle record that is contained in an individual record only if the agency has obtained written consent to the disclosure from the person who is the subject of the record. EFFECTIVE DATE September 1, 2001.
