HBA-CMT H.B. 306 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 306 By: Turner, Bob Public Safety 2/13/2001 Introduced BACKGROUND AND PURPOSE Currently, each peace officer is required to complete a continuing education program at least once every 24 months. The license of a peace officer is subject to suspension if the peace officer fails to comply with this requirement. House Bill 306 credits peace officers serving the state of Texas as an elected member of the legislature with meeting the continuing education requirements. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 306 amends the Occupations Code to require the Commission on Law Enforcement Officer Standards and Education to credit a peace officer with meeting continuing education requirements if the peace officer serves as an elected member of the legislature during the relevant 24-month period in which education is required. The bill provides that credit for continuing education established in this bill does not affect any requirement to demonstrate continuing weapons proficiency required by an agency for which the peace officer is employed. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect on the 91st day after adjournment.
