BACKGROUND AND PURPOSE 

Current law requires a petition for a local option election regarding the
legalization of the sale of mixed beverages to have the signatures,
addresses, and voter registration certificate numbers of 25 percent of the
qualified voters in the relevant subdivision.  The petition must be filed
no later than 30 days after the petition is issued.  As a result, voters
have a short time period to collect the necessary signatures to hold a
local option election.  House Bill 2958 increases the time period in which
signatures can be collected from 30 to 60 days.  

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 2958 provides that a petition for a local option election
related to the legalization of the sale of mixed beverages in an
establishment that holds a food and beverage certificate must be filed no
later than 60 days, rather than 30 days, after the petition is issued. 

EFFECTIVE DATE

September 1, 2001.
