HBA-MSH H.B. 2760 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2760 By: Brown, Betty County Affairs 4/8/2001 Introduced BACKGROUND AND PURPOSE Current law provides that it is the policy of this state that disputes before governmental bodies be resolved as fairly and expeditiously as possible and that each governmental body support this policy by developing and using alternative dispute resolution procedures in appropriate aspects of the governmental body's operations and programs. However, provisions regulating interlocal cooperation contracts do not provide for the application of existing alternative dispute resolution procedures. House Bill 2760 authorizes parties to an interlocal cooperation contracts to use alternative dispute resolution procedures. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2760 amends the Government Code to authorize local governments that are parties to an interlocal cooperation contract to provide in the contract for the submission of disputes arising under the contract to the alternative dispute resolution procedures authorized under the Governmental Dispute Resolution Act. EFFECTIVE DATE September 1, 2001.
