HBA-MPM H.B. 2563 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2563 By: Dunnam Business & Industry 3/29/2001 Introduced BACKGROUND AND PURPOSE The high speeds of motor vehicles and numerous miles that vehicles travel in Texas, as well as the state's diverse road conditions, necessitate that every effort should be made to ensure safety. Many operators of gas stations impose a charge for the use of compressed air and water for the purpose of automobile maintenance. The added charge for air and water may deter some motorists from ensuring that a vehicle maintains proper tire pressure and adequate water in a vehicle's radiator. House Bill 2563 requires a person who operates a gas station to provide water and air to motorists at no additional charge. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2563 amends law to require a person who operates a facility that offers motor vehicle fuel for sale to the public to offer air and water for motor vehicles at no charge. A person who violates this provision commits a Class C misdemeanor. EFFECTIVE DATE September 1, 2001.
