BACKGROUND AND PURPOSE 

Since 1991, the Harris County Water Control and Improvement District No. 84
(district) has been operating in the unincorporated Channelview area of
Harris County, Texas.  Since the creation of the district, subsequent
annexations of land have been made and certain descriptions of current
metes and bounds have been construed as ambiguous.  House Bill 2491
modifies the legal description of the district and validates all
annexations of new tracts into the district. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 2491 validates in all respects all acts of the board of
directors of the Harris County Water Control and Improvement District No.
84 (district) relating to annexations by the district (SECTION 2). The bill
repeals provisions relating to the legal description of the district and
sets forth similar provisions with modifications of the metes and bounds of
the district in order to add tracts and increase the total acreage of the
district from 741.65 acres to 765.7019 acres (SECTIONS 3 and 7). 

The bill provides that this Act does not apply to or affect annexation
orders of the district on or after January 1, 2000.  The bill provides that
if the district adopts any annexation order on or after January 1, 2000,
and before the effective date of this bill, the boundaries of the district
are the boundaries stipulated in this bill as modified to include the land
added by these orders (SECTION 6). 

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001.
