HBA-TBM H.B. 2466 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2466 By: Corte County Affairs 4/1/2001 Introduced BACKGROUND AND PURPOSE Under current law, a court that sentences a defendant convicted of a misdemeanor to confinement in county jail is authorized to require the defendant to reimburse the county for that confinement. House Bill 2466 provides that reimbursement to a county for confinement on a misdemeanor conviction is mandatory. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2466 amends the Code of Criminal Procedure to require a defendant convicted of a misdemeanor or placed on deferred adjudication who also serves a term of confinement in county jail to reimburse the county for the defendant's confinement. If the defendant is determined to be indigent, the convicting court is prohibited from requiring the defendant to reimburse the county as a condition of community supervision, but the amount of reimbursement owed by the defendant is a debt of the defendant owed to the county. EFFECTIVE DATE September 1, 2001.
