Introduced

BACKGROUND AND PURPOSE

Current law authorizes the board of trustees of a school district to adopt
a policy prohibiting students from possessing a paging device while on
school property or while attending a school activity whether the activity
is on or off school property. The law also authorizes a school to
confiscate the paging device and to charge the owner an administrative fee
before the device is released. House Bill 2079 removes the provision
authorizing a school district to charge an administrative fee before
releasing a confiscated paging device.
RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution.

ANALYSIS

House Bill 2079 amends the Education Code to remove the provision that
authorizes a school district to charge the owner of a confiscated paging
device or the student's parent an administrative fee not to exceed $15
before releasing the paging device.

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
