BACKGROUND AND PURPOSE 

Currently, the Dallas/Fort Worth Airport Board of Directors is composed of
11 members from or appointed by the cities of Dallas and Fort Worth.  The
airport actually occupies land and conducts operations in the cities of
Grapevine, Coppell, Irving, and Euless without board representation from
those cities.  Communities in Grapevine, Coppell, Irving, and Euless are
affected by airport operations, but do not have input in airport
development or decision making.  C.S.H.B. 2051 modifies joint board
membership for a county or municipal airport to create a position for a
member from a non-constituent municipality from each county that has
territory within the boundaries of the airport. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

C.S.H.B. 2051 amends the Transportation Code to provide that the joint
board consisting of two or more public agencies (joint board) for which the
constituent agencies are populous home-rule municipalities must include in
its membership from each county that has territory within the airport's
boundaries the chief executive officer of a non-constituent municipality
appointed by the constituent agencies in accordance with the provisions
that govern the joint board.  The bill limits the number of members of a
joint board to 11. The bill prohibits a non-constituent municipality's
chief executive officer from being appointed to a subsequent term until the
chief executive officer of each of the other non-constituent municipalities
has served an intervening term.   The bill provides that a chief executive
officer of a non-constituent municipality serves without reimbursement
except for actual expenses incurred in the performance of official joint
board duties.  The bill requires the joint board to appoint not later than
October 1, 2001 a chief executive officer of a non-constituent municipality
from each county that has territory within the boundaries of the airport to
serve the same term as a member appointed by the governing authority of a
participating agency. 

EFFECTIVE DATE

September 1, 2001.

COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.H.B. 2051 differs from the original by limiting the number of members
of a joint board to 11.  The substitute provides that the chief executive
officer of a non-constituent municipality must be appointed to the joint
board from each county that has territory within the airport's boundaries.
The substitute sets forth provisions relating to the reimbursement of a
chief executive officer of a non-constituent municipality.  The substitute
requires the appointment of the chief executive officers of non-constituent
municipalities to be made not later than October 1, 2001.
