BACKGROUND AND PURPOSE 

Prior to the 77th Legislature, limited exemptions from the competitive
bidding process existed for counties. Under previous law, a county court
was required to submit to the competitive bidding process for services for
and a concession on a county-owned golf course unless the commissioners
court by order granted an exemption that would designate the contract for
management and maintenance of the golf course as a professional service.
If counties were forced to comply with the competitive bidding process,
they would have been required to accept the bid of a contractor who was
under qualified and possibly unable to do the job. House Bill 2002 grants
an exemption from the competitive bidding process for county-owned golf
courses. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 2002 amends the Local Government Code to provide that the
competitive bidding and competitive proposal procedures of the County
Purchasing Act do not apply to the purchase of management services for a
county-owned golf course or a retail facility owned by the county that is
located on the premises of the golf course and landscape and maintenance
services for a county-owned golf course.  This provision applies only to a
county that has a population of 20,000 or less and owns no more than one
golf course open for public use.

June 15, 2001.
