HBA-CMT H.B. 1926 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1926 By: Miller Public Safety 4/29/2001 Introduced BACKGROUND AND PURPOSE Under current law, certain judges are allowed to carry a weapon in this state while engaged in the discharge of their judicial duties. House Bill 1926 removes the requirement that a judge or justice hold a license and allows a judge or justice to carry a weapon regardless of whether they are engaged in the actual discharge of their duties while carrying the weapon. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1926 amends the Penal Code to remove the requirement that certain judges or justices hold a concealed handgun license and to allow a judge or justice to carry a weapon in this state regardless of whether the judge or justice is engaged in the actual discharge of duties while carrying the weapon. EFFECTIVE DATE September 1, 2001.
