HBA-CMT H.B. 1469 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1469 By: Oliveira County Affairs 7/25/2001 Enrolled BACKGROUND AND PURPOSE The growing colonia population in South Texas puts a strain on the infrastructure of that area. Typically, colonia streets have insufficient lighting, creating road and pedestrian safety issues, and possibly serving as an incubator for criminal activity. In the past, counties did not have the authority to make lighting improvements. House Bill 1469 authorizes counties to install streetlights for county roads and assess property owners for lighting improvements. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1469 amends the Transportation Code to authorize a commissioners court of a county to improve a county road by installing a streetlight, and to assess by order all or part of the cost of installing the streetlight against property abutting the improved portion of the county road and against the owners of that property. EFFECTIVE DATE June 14, 2001.
