BACKGROUND AND PURPOSE 

Currently, peace officers from another state and special investigators are
not allowed to carry a weapon in the same manner as a peace officer of this
state.  House Bill 1386 allows peace officers of another state and special
investigators to carry weapons in the same manner as peace officers in this
state.   

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 1386 amends the Penal Code to add special investigators and
peace officers from any other state to the list of persons who may lawfully
carry a weapon and to whom restrictions of carrying a weapon in certain
places do not apply.  The bill also provides that a peace officer of this
state or any other state or special investigator is not prohibited from
carrying a weapon into any establishment within this state serving the
public.  

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001.
