HBA-CMT H.B. 1322 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1322 By: Brimer County Affairs 3/5/2001 Introduced BACKGROUND AND PURPOSE Current law does not address size limitations for political signs located in residential areas, which allows signs intended for major thoroughfares and highways to be placed in residential areas. House Bill 1322 grants cities and counties the authority to regulate the size of political signs in residential areas. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1322 amends the Local Government Code to authorize a municipality or a commissioners court to regulate the size of a sign or billboard located in a residential area by charter, ordinance, or order as applicable. The bill prohibits a sign located in a residential area, including a political sign, from being larger than 36 inches by 36 inches in size. A violation of a charter provision, ordinance, or order adopted under the provisions of this bill are punishable by a fine of up to $1,000. EFFECTIVE DATE September 1, 2001.
