HBA-JEK, NRS H.B. 1316 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1316 By: Farabee Public Health 3/6/2001 Introduced BACKGROUND AND PURPOSE Under current law, the first $50,000 of a trust that belongs to a client of a mental health community center or a patient at a state hospital is not liable for the client's or patient's support. House Bill 1316 raises the amount at which a trust becomes liable for a patient's or client's care to $250,000. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1316 amends the Health and Safety Code to increase from $50,000 to $250,000 the amount of principal of a trust held by a client of a mental health community center or a patient of a state hospital that is not considered to be the client's or the patient's property and is not liable for the client's or patient's support. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
