HBA-NRS C.S.H.B. 118 77(R)BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 118 By: Wise Public Safety 3/8/2001 Committee Report (Substituted) BACKGROUND AND PURPOSE Under current law, a person is eligible to receive a concealed handgun license if the person meets certain criteria and pays the $140 application and license fee. Certain persons are permitted to pay a reduced fee. C.S.H.B. 118 authorizes a person who is a member of the state military forces to apply for a concealed handgun license and pay a fee of $25 to receive the license. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS C.S.H.B. 118 amends the Government Code to require the Department of Public Safety (DPS) to charge a fee in the amount of $25 for the issuance of an original license to carry a concealed handgun and a fee in an amount not to exceed $25 for the issuance of a duplicate, modified, or renewed license to carry a concealed handgun if DPS determines that the applicant is a member of the state military forces. The bill requires DPS to require a member of the state military forces who applies for a license to carry a concealed handgun to submit proof of membership in the state military forces with the application materials for the issuance of a license to carry a concealed handgun. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001. COMPARISON OF ORIGINAL TO SUBSTITUTE The substitute modifies the original bill by removing provisions relating to the application of a member of the state military forces for a license to carry a concealed handgun, which included a requirement for submission of a sworn statement of the applicant's commanding officer regarding the applicant's suitability for a license to carry a concealed handgun.
