HBA-NRS C.S.H.B. 116 77(R) BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 116 By: Najera Public Safety 3/1/2001 Committee Report (Substituted) BACKGROUND AND PURPOSE Under current federal law, a man between the ages of 18 and 26 must register with the United States Selective Service System (system). A man who is not registered with the system in accordance with federal law is ineligible to receive federal funds and state student loans and may not be hired as a state employee. C.S.H.B. 116 requires the Department of Public Safety to electronically send information, including the applicant's social security number, from an application for a driver's license to the United States Selective Service System for the purpose of registering an applicant under the Military Selective Service Act. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS C.S.H.B. 116 amends the Transportation Code to authorize information provided on a driver's license application that relates to the applicant's social security number to be used only by the Department of Public Safety (DPS) or disclosed to the United States Selective Service System (system). The bill requires DPS to send in an electronic format information, including the applicant's social security number, from an application for a driver's license submitted by a male applicant to the system for the purpose of registering the applicant under the Military Selective Service Act. The bill prohibits DPS from issuing a driver's license to the applicant if the applicant does not submit the necessary information. Before accepting an application from an applicant, the bill requires DPS to notify the applicant that the application for a driver's license also constitutes registration with the system for persons who are subject to registration and who have not previously registered. The bill provides that the applicant's submission of an application following this notification constitutes the applicant's consent to the sending of the information, including the applicant's social security number, and to the registration. The bill authorizes DPS to post signs providing the information contained in the notification in English and Spanish at each location where applications for driver's licenses are accepted. EFFECTIVE DATE September 1, 2001. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 116 modifies the original by authorizing the disclosure to the United States Selective Service System (system) of information provided on a driver's license application that relates to an applicant's social security number. The substitute prohibits the Department of Public Safety (DPS) from issuing a driver's license to the applicant if the applicant does not submit the necessary information. The substitute no longer requires DPS to send information from an application for a personal identification certificate to the system. The substitute removes provisions in the original relating to a personal identification certificate and removes the provision stating that the required registration with the system does not apply to an applicant concerning whom DPS has previously sent information to the system. The substitute removes the requirement that the notification DPS provides applicants concerning registration be given orally.
