HBA-DMD S.B. 965 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 965 By: Lucio Public Safety 5/11/1999 Engrossed BACKGROUND AND PURPOSE Currently, certain federal criminal investigators have powers of arrest, search, and seizure as to felony offenses under the laws of this state. S.B. 965 grants the powers of arrest, search, and seizure as to any offense under the laws of this state committed within the boundaries of a national park or national recreation area to commissioned law enforcement officers of the National Park Service. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 2.122, Code of Criminal Procedure, by adding Subsection (d), to provide that a commissioned law enforcement officer of the National Park Service is not a peace officer under the laws of this state, except that the officer has the powers of arrest, search, and seizure as to any offense under the laws of this state committed within the boundaries of a national park or national recreation area. Defines "national park or national recreation area" in this subsection. SECTION 2.Emergency clause. Effective date: upon passage.
