HBA-CDB S.B. 825 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 825 By: Zaffirini State Affairs 4/29/1999 Engrossed BACKGROUND AND PURPOSE Under current law, certain aerial fireworks can only be sold to the public between June 24 and July 4, and between December 20 and January 1, of each year. However, a county commissioners court is authorized to issue an order prohibiting or restricting the sale of certain fireworks due to the existence of drought conditions, if the order is made before June 15, for the Fourth of July fireworks season, or December 15, for the December fireworks season. S.B. 825 lengthens the time period in which a commissioners court may issue an order prohibiting or restricting the use of certain aerial fireworks during drought conditions. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 240.904(d), Local Government Code, to provide that a county commissioners court order prohibiting or restricting the use of certain fireworks during drought conditions must be adopted before June 21 , rather than June 15, of each year for the Fourth of July fireworks season and December 17, rather than December 15, of each year for each December fireworks season. SECTION 2.Emergency clause. Effective date: upon passage.
