BACKGROUND AND PURPOSE 

Currently, upon election to the office of county treasurer and prior to
being sworn in, the elected individual must post a bond within 20 days
after the certificate of election is received.  S.B. 778 provides that the
county treasurer instead execute a bond prior to performing any duties of
the office. This bill removes the provision that a bond must be executed
within 20 days after receiving a certificate of election.   

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 83.002(a), Local Government Code, to provide
that the county treasurer execute a bond before beginning the performance
of office duties.  Deletes existing text providing for the execution of a
bond within 20 days after the date the certificate of election is received.
Makes a nonsubstantive change. 

SECTION 2.  Makes application of this Act prospective.

SECTION 3.  Emergency clause.
  Effective date: upon passage.
