HBA-NLM S.B. 338 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 338 By: Madla County Affairs 4/11/1999 Engrossed BACKGROUND AND PURPOSE Currently, a commissioners court (court) must hold a public hearing on a proposed budget within 7 days after the day the budget is filed with the county clerk. However, the court is required to publish notice of the hearing no later than the 10th day before the date of the hearing. Therefore, the public is unable to view the proposed budget for 3 days after notice of the hearing is posted. This bill changes the period of time that the court must hold a public hearing after a proposed budget is filed with the county clerk from 7 days to 10 days, to allow the public the full 10 days to review the proposed budget before the hearing. S.B. 338 requires the commissioners court to hold the hearing on a day within 10, rather than seven, calendar days after the date the proposed budget is filed but before the last day of the first month of the fiscal year. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 111.038(b), Local Government Code, to require a commissioners court to hold the required budget hearing on a day within 10, rather than seven, calendar days after the date the proposed budget is filed but before the last day of the first month of the fiscal year. SECTION 2. Amends Section 111.067(b), Local Government Code, to make a conforming change. SECTION 3. Emergency clause. Effective date: upon passage.
