BACKGROUND AND PURPOSE

Hidalgo County wishes to contract with a private vendor for the design of a
local jail facility that the county would run upon completion. However,
Section 351.103, Local Government Code, lists 10 requirements that must be
contained in a contract with a private vendor, which assume that the
private vendor will run or manage the facility requiring the vendor to make
certain provisions. S.B. 1730 establishes conditions regarding county
contracts with private entities for jail facilities.
