HBA-GUM S.B. 1558 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1558 By: Nelson Criminal Jurisprudence 4/30/1999 Engrossed BACKGROUND AND PURPOSE Current law regarding trespassing is applied only to real property or buildings, and not to boats, aircraft, or motor-propelled vehicles. Airport security has been unable to use the trespass statute to deal with passengers who violate certain conditions. S.B. 1558 establishes trespassing on an aircraft as an offense. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 30.05(a), Penal Code, to include that entering or remaining on an aircraft of another person without effective consent, after having notice that the entry was forbidden or receiving notice to depart but failing to do so, constitutes an offense. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
