HBA-DMD S.B. 1545 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1545 By: Sibley State, Federal, & International Relations 4/22/1999 Engrossed BACKGROUND AND PURPOSE Under current Texas law, the Texas State Cemetery Committee (committee) has the authority to authorize the burial of a person in the state cemetery (cemetery) only during a period in which the legislature is not convened, and only if the committee finds that the person to be buried made a significant contribution to Texas history. S.B. 1545 gives the committee the authority to authorize a burial in the cemetery during the legislative session. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subsection (e), Section 2165.256, Government Code, to delete the authority of the Texas State Cemetery Committee (committee) to authorize a burial in the state cemetery only during a period in which the legislature is not convened in regular or special session, thus authorizing the committee to authorize a burial only if the committee finds that the person made a significant contribution to Texas history. SECTION 2.Effective date: September 1, 1999. SECTION 3. Emergency clause.
