HBA-DMD S.B. 1426 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1426 By: Duncan State, Federal, & International Relations 5/7/1999 Engrossed BACKGROUND AND PURPOSE The Lubbock Reese Redevelopment Authority (authority) was created by the Legislature during the 75th Session. Since the closure of Reese Air Force Base the authority has been responsible for overseeing the transition of the base from a military operation to a variety of uses. S.B. 1426 specifies the required appointment strategy for successor members of the board of directors of the Lubbock Reese Redevelopment Authority (member), in order to implement staggered terms of office, beginning on October 1, 1999, at the expiration of the terms of office of the initial board. This bill provides that at the expiration of certain two and four year terms of office, all following terms of office are required to be for a period of four years. This bill also requires a member appointed to fill a vacancy for an unexpired term, to serve only for the remainder of that term. In addition, this bill authorizes a member to be appointed to succeed himself or herself on the board. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 396.003, Local Government Code, as follows: (c) Specifies the required appointment strategy for successor members of the board of directors of the Lubbock Reese Redevelopment Authority (member), in order to implement staggered terms of office, beginning on October 1, 1999, at the expiration of the terms of office of the initial board. (e) Provides that at the expiration of the two and four year terms of office provided for under Subsection (d), all following terms of office are required to be for a period of four years. Requires a member appointed to fill a vacancy for an unexpired term to serve for the remainder of that term only. Authorizes a member to be appointed to succeed himself or herself on the board. Deletes text providing that each board member serves a term of two years. (f) Redesignated from Subsection (d). (g) Redesignated from Subsection (e). SECTION 2. Amends Section 2311.003, Government Code, to make conforming changes. Redesignates Subsections (d)-(f) to Subsections (f)-(h), respectively. SECTION 3. (a) Effective date: September 1, 1999, except as provided by Subsections (b) and (c) of this section. (b) Provides that Section 1 of this Act takes effect only if the Act of the 76th Legislature, Regular Session, 1999, relating to nonsubstantive additions to and corrections in enacted codes takes effect. (c) Provides that Section 2 of this Act takes effect only if the Act of the 76th Legislature, Regular Session, 1999, relating to nonsubstantive additions to and corrections in enacted codes does not take effect.
