BACKGROUND AND PURPOSE 

Currently, Tarrant County's health and human services clearinghouse
provider must employ the competitive bidding process in order to lease
space to for-profit agencies. S.B. 141 authorizes the commissioners court
of certain counties to lease real property owned or controlled by the
county to a for-profit entity in order to conduct health and human service
activities.  

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 263.007(e), Local Government Code, to authorize
the commissioners court of a county with a population of one million or
more that contains two or more municipalities with a population of 250,000
or more, to lease real property owned or controlled by the county to a
for-profit entity in order to conduct health and human service activities
which the commissioners court finds to be in the public interest, without
using the sealed-bid or sealed-proposal process described in Subsection (a)
and without using any other competitive bidding process which would
otherwise be required by law. 

SECTION 2.Effective date: September 1, 1999.

SECTION 3.Emergency clause.
