HBA-KMH S.B. 114 76(R)BILL ANALYSIS Office of House Bill AnalysisS.B. 114 By: Gallegos Criminal Jurisprudence 4/23/1999 Engrossed BACKGROUND AND PURPOSE Currently, a person is considered intoxicated if the person has an alcohol concentration of 0.10 or more. S.B. 114 redefines "intoxicated" by reducing the level of alcohol concentration to 0.08 or more, rather than 0.10 or more. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 49.01(2), Penal Code, to redefine "intoxicated" by changing the level of alcohol concentration to 0.08 or more, rather than 0.10 or more. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
