BACKGROUND AND PURPOSE 

The 75th Texas Legislature, Regular Session, enacted Section 242.1225,
Health and Safety Code (Additional Reporting Requirement), as part of the
model nursing home regulation legislation.  The information regarding abuse
and neglect required by Section 242.1225 is already required to be reported
under Section 242.122 (Reporting of Abuse and Neglect). C.S.S.B. 109
repeals Section 242.1225, regarding the additional reporting requirement.
C.S.S.B. 109 also authorizes public members of the long-term care
legislative oversight committee (committee) to be reimbursed for expenses
incurred while conducting committee business. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Repealer: Section 242.1225, Health and Safety Code (regarding
the additional reporting requirement for convalescent and nursing homes and
related institutions).  Section 242.1225 currently requires the Texas Board
of Human Services to adopt rules that require any person, including the
owner or employee of an institution, to report conditions or conduct which
result in accidental injury, exploitation, or hospitalization of residents. 

SECTION 2.  Amends Section 242.066(f), Health and Safety Code, to make a
conforming change. 

SECTION 3.  Amends Section 242.0665(b), Health and Safety Code, to make a
conforming change. 

SECTION 4. Amends Section 242.652, Health and Safety Code, by adding
Subsection (d), to authorize a public member of the long-term care
legislative oversight committee (committee) to a travel expense
reimbursement, at the rate established by the General Appropriations Act,
for expenses incurred while conducting the business of the committee.  

SECTION 5.  Emergency clause.
  Effective date: upon passage.

COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.S.B. 109 modifies the original bill by adding SECTION 4 authorizing a
public member of the long-term care legislative oversight committee
(committee) to a travel expense reimbursement, at a rate established by the
General Appropriations Act, for expenses incurred by the member while
conducting committee business. 

C.S.S.B. 109 modifies the original bill by redesignating SECTION 4 of the
bill to SECTION 5.
