BACKGROUND AND PURPOSE 

Currently, the law requires that certain state agencies file a roster of
licensees with the secretary of state, which makes a record of the filing
and then transfers the report to the Texas State Library and Archives
Commission for long-term retention.  H.B. 939 deletes the requirement of
filing a roster with the secretary of state, and in some cases removes the
secretary of state as the provider of certified copies.  The roster of
licensees will be retained by the originating agency, which may provide
certified copies upon request.   

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 50.008(a), Human Resources Code, to delete a
requirement that a roster of all licensed master social workers, licensed
social workers, and social work associates be placed on file with the
secretary of state by the Board of Social Work Examiners. 

SECTION 2.  Amends Section 11, The Texas Engineering Practice Act, Article
3271a, V.T.C.S., to delete a requirement that a roster of all licensed
professional engineers be placed on file with the secretary of state by the
Texas Board of Professional Engineers. 

SECTION 3.  Amends Section 5, Chapter 94, Acts of the 51st Legislature,
Regular Session, 1949,  
Article 4512b, V.T.C.S., to delete a requirement that a register of all
applicants for license be transmitted to the secretary of state by the
Texas Board of Chiropractic Examiners.  Makes conforming and nonsubstantive
changes. 

SECTION 4.  Amends Section 18, Psychologists' Licensing Act, Article 4512c,
V.T.C.S., to delete a requirement that a list of all certified or licensed
psychologists be placed on file with the secretary of state by the Texas
State Board of Examiners of Psychologists. 

SECTION 5.  Amends Section 4(b), Chapter 836, Acts of the 62nd Legislature,
Regular Session, 1971, Article 4512e, V.T.C.S., to delete a requirement
that a register of all licensed physical therapists be transmitted to the
secretary of state for permanent record by the coordinator of physical
therapy programs. 

SECTION 6.  Amends Section 2.06(b), Texas Optometry Act, Article 4552-2.06,
V.T.C.S., to delete a requirement that a record of all applicants for
examination be sent to the secretary of state by the executive director of
the Texas Optometry Board.  Makes conforming and nonsubstantive changes. 

SECTION 7.  Amends Section 2E(2), Chapter 251, Acts of the 53rd
Legislature, Regular Session, 1953, Article 4582b, V.T.C.S., to delete a
requirement that a list of all licensed funeral directors, embalmers, and
funeral establishments be filed with the secretary of state for permanent
record by the Texas Funeral Service Commission.  Makes conforming and
nonsubstantive changes 


 SECTION 8.  Amends Section 3(f), Occupational Therapy Practice Act,
Article 8851, V.T.C.S., to delete a requirement that a register of all
licensed occupational therapists be transmitted to the secretary of state
for permanent record by the coordinator of occupational therapy programs. 

SECTION 9.  Amends Section 8(b), The Property Taxation Professional
Certification Act, Article 8885, V.T.C.S., to delete a requirement that a
roster of all persons registered with the board be placed on file with the
secretary of state by the Board of Tax Professional Examiners. 

SECTION 10. Amends Section 11(b), Orthotics and Prosthetics Act, Article
8920, V.T.C.S., to delete a requirement that a register of all persons
holding a license be sent by the executive director of the Texas Board of
Orthotics and Prosthetics to the secretary of state for permanent record.
Makes nonsubstantive change. 

SECTION 11.  Effective date: September 1, 1999.

SECTION 12.  Emergency clause.
